Kapuskasing Man Appealing His Life Sentence

A Kapuskasing man currently serving life is appealing that his punishment is excessively harsh.

Patrick Carignan, found guilty in November of the second-degree murder of 23-year-old Moonbeam mother of three Emmanuelle D’Amours, is now appealing that his punishment is too harsh.

At the hearing in March, Carignan’s lawyer appealed his client deserved the minimum period of 10 years without parole, while the Crown Attorney pushed for 17 years.

In the end, Judge Cindy MacDonald ruled 16 years without eligibility for parole, based on the factor that Carignan had to look his victim in the eye, see her struggle, and still chose to persist with assaulting her despite this.

Following his sentencing in March to life imprisonment without parole for 16 years, Carignan has filed with the Ontario Court of Appeal saying his punishment is too excessive for the case.
